As Registers of Scotland continue with their plans to transfer all titles from the Register of Sasines to the Land Register by 2024, all land owners will see a change in the way their titles are held at the Registers of Scotland. At Stodarts, our clients see the benefit of instructing us to attend to a voluntary registration on their behalf, rather than leave it to chance.
Avoiding Inaccuracies
It is not unusual for the extent of farming land to change over time, with boundaries and servitudes being regulated by farmers themselves outwith the Register of Sasines. Registers of Scotland will be unlikely give effect to these arrangements when they transfer the title from one system to the other as they will not necessarily know about them. This can create inaccuracies which cause difficulties in relation to not only purchases and sales, but succession to land as well as the granting of servitude rights or farming grants as the extent of the land is in question.
